Is there a nice way to say.... you may buy prints but you don't OWN them.....

that when someone buys a print off your site, that even though they pay for it, they don't OWN it... I know we always plaster all rights remain with the artist... but Walt over heard someone talking about a photog who took their images off a site and they paid the guy for his travel ... not his time or images...

so what I'm worried about is the ignorant customer... perhaps they don't understand what "all rights remain with artist" actually means.

I'm working on Walt dot com... and I've got a flash slide show so they can't right click... (net images anywho)... but on the how to buy prints page (we don't have a shopping cart yet... and may not get one if this system works).... I just want a kind reminder that doesn't make us sound be-yochie...

or am I just borrowing trouble?

sigh... 2 months ago (before my stroke) I could have figured this out in a New York minute... now... geez... I can't remember anything and it has literally taken me a couple of MONTHS to get Walt's site up and something on it... besides a "excuse our dust" page.

thanks ya'll.... I always love the advise I get here.

    They OWN the print.

But they don't own the image.

I would find a simple way of explaining that unless they purchase the full rights to the image (and make the cost like $50,000), then you as the artist have the right to reprint that image and sell it to another client/customer.

They, as the owner of the print, only have the right to display the print, they do not have reprint rights or anything like that.

    Does that make sense?

oh yea, makes perfect sence to me.... but making them understand that.

I wonder how I can say that on the page... so they know without asking (or feeling stupid for asking) about copyrights...  hmmm.... maybe a FAQ section that covers this....

maybe have some "customer" questions addressed in it... like "once I buy the print, can I scan it and share it with Uncle George?"  answer "sure, after you purchase the image rights.  You may wish to take out a second mortgage on your home in order to finance this"  of course I'm all tongue and cheek here.... maybe something a little less tart... but still gets the message across...

I dunno... maybe I won't do a thing unless I actually have the problem... but at least I can kinda be prepaired and not taken off guard.

We're working on building a website as well. And like everyone else, we're share your concerns. Here is the solution we've come up with. Since we haven't implemented it yet, I can't tell you how well it will work!

Andrew, my husband/webmaster, came up with this copyright notice. We're going to have them click through this before view pictures to order.

    Copyright Warning

At Gearhart Family Photography, also known as GFP, we are trying to make an honest dollar by creating great images that are affordable. By respecting our copyright, you will help us continue to hit that mark. Before continuing, please read and agree to the following.

    • retrieving the material from this website to be edited and used in any way
    • retrieving the material from this website to print in your home
    • retrieving the material from this website to be printed by a photo printing service
    • retrieving the material from this website to be viewed via a mechanism other than a web browser

If you require digital rights for any of these purposes, please contact us for details on how to obtain these permissions.

By continuing to use this site, you acknowledge that you've read and understand this warning.

    Hope that helps!

    WOW!  I love it....

Right now I'm using  low resolution images that walt is supplying me... I then put a watermark in the lower right corner (does not obscure image) THEN I use a program to make a flash slide show... so if anyone does snag them they have to do print screen... by that time what they get is so tiny it "might" be usable in a baseball card size print...

BUT... I do love what ya'll came up with... and having them click thru it prior to getting to the images... WOW... may I borrow that?  it might be worth doing something of that nature in order to have peace of mind.

Are you going to put an agree/disagree to terms on here?  so if they don't agree they can't see the images?.... hmmm wonder how I'd do that... does your hubby know how?

I'm sorry.... at one time this kind of thing would not have been an issue (html codes) but now... I'm having to relearn and my level of retention has deminished greatly after the stroke (by the way, found out you don't have to be OLD to have them.... some folks with chronic migraines are more likely to have a stroke at a young age... me at 44)

Thanks again... if you want me to click thru your site... I'd be happy to be your test rat...

    Borrow away!

We're putting up low res images too, figuring that like you said, they couldn't get anything good out of it anyways.

I'm not sure if he plans on doing a agree/disagree kinda thing or not. I'm sure he knows how...  though I sure don't!

Our site is http://photo.gearhart.org . Feel free to take a look. It's not done yet though! We've got two boys under 3, full time jobs and part time jobs. So, he ends up working on it in the little spare time he's got.  He's got it all planned out, just needs to finish the coding.

Sorry to hear about your stroke. At 44, that must have been scary! Keep plugging away! From your posts it seems like you're getting your grove back!
